i do not know anything about this specific issue,
but i can tell you something.

while making the dvd-0.3.3-jau-p2 patch,
i learned, that the a memeber audioTrack was being used, but not
and never explicitly initialized !
so sometimes at startup it was not 0, meaning sometimes i have heard no
audio at all .. this was one part of the patch ;-)

may be its the same here ..

so you might want to use the latest libdvdnav CVS version,
and use such dvdnav_ functions to determine which subtitle 
is currently being used by libdvdnav .. just a guess.
