Wouldn't

case `uname -r` in
     2.4.*)
         DVBDIR=../DVB
         ;;
     *)
         DVBDIR=lib/modules/`uname -r`/build
         ;;
esac

be better? Otherwise kernel 2.7 and up would use the "old" driver again...
