please use a current driver source tree from CVS.
check it out using

$ cvs -d :pserver:anonymous@linuxtv.org:/cvs/linuxtv login
[press enter]
$ cvs -d :pserver:anonymous@linuxtv.org:/cvs/linuxtv co DVB
