I think that "scan" must be making the mistake of believing the service information :-).

The RTE radio stations (10744h SR 22000) are transmitted with the "free_CA_mode" flag set to "CA" in the SDT. However, there are no conditional access descriptors specifying the type of conditional access system, so scan could ignore the "free_CA_mode" flag, and just check for the presence of CA descriptors instead.
